2A Marketplace Terms of Service and User Agreement

1. Introduction and Binding Agreement

By accessing or using https://www.2amarketplace.com, including all subdomains and affiliated sites (the “Site”), you expressly agree to be bound by these Terms of Service, our Privacy Policy, and our Site Rules. This Agreement is a binding commitment between you (and your Company, if applicable) and 2A Marketplace, LLC (“the Company”).

If you do not agree to these Terms, you are not authorized to use the Site or its content.

2. Registration and Account Integrity

  • Eligibility: You affirm you are of legal age in your jurisdiction and possess the legal capacity to enter into binding contracts.

  • Single Account Policy: You agree to maintain only one (1) account. Use of multiple accounts to evade bans, manipulate listings, or “spam” the community is strictly prohibited.

  • Accuracy of PII: All Personally Identifiable Information (PII) provided—including name, address, and mobile number—must be truthful and current.

  • Termination: We reserve the right to decline registration or deactivate accounts at our sole discretion, without prior notice or stated cause. Accounts inactive for one year may be marked as closed, though data may be retained for legal records.

3. Venue Only Disclosure

  • No Agency: 2A Marketplace is an advertising venue only. We are not auctioneers, firearms dealers, or brokers.

  • No Certification: We do not certify, investigate, or guarantee the legal capacity of any party to transact. We are not involved in the actual movement of funds or items between buyers and sellers.

  • Assumption of Risk: You are responsible for your own safety. You acknowledge that sending money in advance of verifying an item’s existence or a seller’s credibility is extremely risky.

4. Financial Terms and Payment Security

  • Non-Refundable Fees: ALL FEES PAID TO 2A MARKETPLACE ARE NON-REFUNDABLE.

  • Credit Card/ACH Authorization: By providing payment info, you authorize charges for incurred fees. To revoke this authorization, you must send a written request to: 2A Marketplace, LLC, PO Box [Your PO Box], [Your City, State, Zip].

  • Chargeback Waiver: By using a credit card, you unconditionally waive any and all chargeback rights. Unauthorized chargebacks will result in account termination and a $50 processing and collection fee.

  • Verification: To reduce fraud, users must verify accounts with a credit/debit card in their own name. Prepaid gift cards are not accepted.

5. Listing Policies and Prohibitions

To ensure a high-quality community, you agree to the following specific listing rules:

  • Quantity Limits: Limit one (1) item per ad, and one (1) ad per item.

  • Ammunition Rules:

    • Standard Ammo Ads: For individuals selling less than 174 rounds (or 4 boxes) of the same caliber.

    • Bulk Ammo Ads: Required for any ads selling 174+ rounds (or 4+ boxes).

    • Caliber Limit: Limit 1 caliber per ad.

  • Prohibited Content: No profanity, disparaging ads, tag spamming, or PSAs.

  • Information Ciphers: Phone numbers, web addresses, or emails (and their ciphers/code versions) are strictly prohibited in titles, descriptions, or display names.

  • Upgraded Packages Required: You may not advertise websites, giveaways, raffles, auctions, job postings, or “lowest price guarantees” without a specific business advertisement package.

6. Legal Compliance and ATF Disclosures

  • General Compliance: You must comply with all local, state, and federal laws regarding the sale, transfer, and shipping of items (including knives and ammunition).

  • FFL Usage: For interstate transactions or whenever required by law, firearms must be transferred via a Federal Firearms License (FFL) holder.

  • “Engaged in the Business” (ATF 2022R-17F): You acknowledge that the ATF amended the definition of who qualifies as a “Dealer in Firearms” on April 19, 2024. It is your sole responsibility to determine if your frequency of selling requires an FFL under this Amendment. 2A Marketplace does not provide legal advice.

  • U.S. Sanctions: You warrant that you are not in an embargoed country and are not on any U.S. restricted parties list.

7. Intellectual Property and Data Protection

  • Ownership: All content (images, text, code, and data compilations) is the exclusive property of 2A Marketplace.

  • Anti-Scraping: Collecting data and re-publishing it without express written permission is strictly prohibited.

  • Civil Damages: Violations of data use/copyright are subject to liquidated damages of no less than $750 per instance.

  • User Submissions: Any feedback or reviews submitted become the property of the Company.

8. Limitation of Liability and Release

  • Disclaimer: The Site is provided “As-Is” and “As-Available”. We do not guarantee uninterrupted service.

  • Liability Cap: The total aggregate liability of the Company for any claim shall not exceed the amount you paid us for the specific service giving rise to the claim.

  • Release: In any dispute with another user, you release 2A Marketplace and its officers from all claims, demands, and damages.

9. Mandatory Arbitration and Dispute Resolution

YOU EXPRESSLY WAIVE THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

  • Any controversy relating to this Agreement shall be resolved solely by binding arbitration administered by the American Arbitration Association (AAA).

  • The arbitration shall be conducted before a single arbitrator in [Your State].

  • This provision is governed by the Federal Arbitration Act.

10. Indemnification

You agree to indemnify and hold harmless 2A Marketplace, LLC and its agents from any loss, harm, or expense (including attorney fees) caused by your use of the Site, your violation of these terms, or your violation of any law (including direct or indirect results of illegal firearm transfers).
